Comprehensive legal clerkship, doctorate and scientific assistant for almost 5 years at the Max Planck Institute for Foreign and International Private Law, Hamburg, department of Spain-Portugal and -Latin America – (among others, expert opinions on behalf of the Institute on international private law and foreign law for courts and lawyers, in addition also independent private expert opinions with a focus on foreign commercial law with Prof. Dr. Fernandez de la Gándara).

Max-Planck Institute: comparative contract law doctorate for the unification of European contract law for the Unidroit Institute in Rome with special consideration of US-American law for the exemplary approximation of Common Law and Civil Law. 15 examined legal systems. Result essentially adopted in model regulations for legislators and legal users in the “Principles of International Commercial Contracts, 1994 Unidroit (see also versions of 2004/2010) in Art. 3.5/3.11.

Second state examination in law (1974) and completion of bank training (1975) in Hamburg.

Authorised signatory and responsible commercial lawyer in the German-Brazilian banking group in Sao Paulo from 1975 to 1976.

Commercial management: Establishment of a foreign organization of a European construction company with more than 2000 employees in Essen from 1976 to 1979, further legal cooperation until the sale of the company in 2001, in particular foundation, tax planning and commercial-legal support of 27 subsidiaries and branches in Germany and abroad with a focus on construction law as well as of internationally active sister companies of various branches of the group, training and legal disputes and e.g. independent contract negotiation and personal support from years of preparation of the proceedings in Hong Kong and London to the successful arbitration decision in London of the largest construction contract in the history of the company in Hong Kong (Tsing Ma Bridge) with English and Chinese partners/opponents under English law and UN Arbitration Law from 1992 to 2001.

Constantly holding various supervisory board as well as management mandates since 1975, e.g. Supervisory Board of Aachen-Münchener Versicherung, Sao Paulo / Managing Director of the company Kienzle, Sao Paulo / Chairman of the Supervisory Board of Hawesko Holding AG, Hamburg after initiation and significant legal and tax contribution with the first negotiation until IPO, Hamburg or Chairman of the Supervisory Board of Tate & Lyle Food Systems, Lübeck with subsidiaries in almost all continents with corresponding initiating legal and tax contribution with the first negotiation until closing. Currently Managing Director of Katharina Hahn Familien GmbH, Berlin, and Katharina Hahn GmbH & Co. KG, Lübeck, / Member of the Board of Directors of Wergen & Partner Vermögensverwaltungs AG, Zurich and previously numerous other advisory and supervisory board positions in medium-sized companies (e.g. at Deutsche Media Group GmbH, Hamburg, at TechniGraphics GmbH, Steinebach or at the Nietiedt Group, Wilhelmshaven, KaTech Katharina Hahn+Partner GmbH, Lübeck and Seccua Holding AG, Steingaden).

Since 1994, specialist lawyer for tax law with a focus on cross-border matters after submission to the Hanseatic Bar Association of a cross-border corporate and tax planning for the acquisition of an international forwarding agency, taking into account Germany, the Netherlands, Luxembourg, Spain, United States of America, and England as the future domicile for an acquiring and lasting holding company with the result of London as place of business and many years of membership in the Board of Directors of this English international holding company.

Contribution of his successes achieved for clients to a family office, in particular in executive responsibility in the international Katharina Hahn Group.

In Germany and various countries: Publication of numerous technical essays: Core topics of international and foreign private law and international tax law.

Dr. Schwarz has worked as a lawyer within more than 60 countries and has also worked with a further 20 countries to develop their legal and tax systems for specific assignments, strategically applying their reflective effects on German law and tax law or on other home rights and developing solutions for cross-border entrepreneurial investments. Particularly successful negotiation management, both in Germany and abroad, and the recording of mentality-related peculiarities are noteworthy.

Involvement in the re-establishment of the parental estate in Mecklenburg.

Dr. Hubertus Schwarz has published various articles on German and foreign civil and real estate law, corporate law, tax law and licensing law in German, Spanish and Portuguese specialist books and journals.

These journals include Recht der nternationalen Wirtschaft (RIW), Internationale Wirtschafts-Briefe (IWB), Die Wirtschaftsprüfung (WPg), Anuario de Derecho Civil (Madrid) and Revista de Direito e de Estudos Sociais (Coimbra).

In addition, Dr. Hubertus Schwarz has written on current legal issues for Welt am Sonntag (origin of the website “Weltrecht”), the Frankfurter Allgemeine Zeitung (FAZ) group and the Handelsblatt.
